1. Service Description

Recoverly ("we," "our," or "us") provides an automated SMS-based missed-call recovery service for service businesses. When your customers call your business and you're unable to answer, our system sends an SMS to capture their service request details and forwards them to you.

2. SMS Consent & Communication

Important: SMS Consent is Separate

Your agreement to these Terms of Service does NOT constitute consent to receive SMS messages on behalf of your customers. SMS consent is obtained separately through our explicit opt-in process.

How SMS Consent Works:

  1. Customer Calls: A customer calls your business phone number but you're unable to answer.
  2. Explicit Consent Request: We send ONE message asking for consent:
    "Hi! You just called [Your Business]. Can I help you over text? Reply YES to continue or STOP to opt out."
  3. Customer Response: The customer must actively reply "YES" before any conversation begins.
  4. Conversation Begins: Only after receiving consent do we start the service request conversation.

Opt-Out Rights:

Customers can opt out at ANY time by replying "STOP" to any message. We immediately:

  • Stop all SMS communication
  • Add their number to a permanent suppression list
  • Send a confirmation message

Message Frequency: Varies. Customers only receive messages when they call and consent to text communication. Typical conversation: 3-6 messages total to capture service request details.

Message & Data Rates: Standard message and data rates may apply based on the customer's mobile carrier.

Supported Carriers: All major U.S. carriers are supported. For support, customers can email [email protected].

3. Your Responsibilities as a Business

By using Recoverly, you agree to:

  • Provide accurate business information and contact details
  • Respond to jobs captured by our system in a timely manner
  • Comply with all applicable laws regarding business communications
  • Not use the service for spam, harassment, or illegal activities
  • Maintain an active subscription to continue using the service

4. Subscription & Billing

Recoverly operates on a subscription basis. Founding Users selected for the Founding User Program receive free lifetime access in exchange for honest product feedback. Regular pricing is $29/month with a 14-day free trial. You may cancel at any time. Subscriptions auto-renew unless cancelled.

5. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for missed calls or messages due to service outages, carrier issues, or customer phone settings (Do Not Disturb, blocked numbers, etc.).

6. Data & Privacy

We collect and process customer phone numbers and conversation data to provide our service. See our Privacy Policy for details. We never sell customer data to third parties.

7. Limitation of Liability

Recoverly is provided "as is" without warranties. We are not liable for lost business, missed opportunities, or any indirect damages. Our total liability is limited to the amount you paid in the last 12 months (maximum $348).

8. Termination

You may cancel your subscription at any time. We may terminate service for violation of these terms, non-payment, or illegal use. Upon termination, your data will be retained for 30 days, then deleted.

9. Changes to Terms

We may update these terms periodically. Continued use of the service after changes constitutes acceptance. Material changes will be communicated via email.
